NASCAR Cup Series rivals are growing increasingly frustrated with 23XI Racing as their lawsuit against the stock car racing series approaches, according to a report.
Last October, 23XI and FRM sued NASCAR after refusing to sign up to their new charter agreement, alleging anticompetitive and monopolistic practices.
Since then, NASCAR and the teams have gone back and forth in court over several issues, with no settlement having been reached at any stage so far.
The biggest developments in the case over the past few months have been 23XI and FRM losing their charters, which had previously been granted to them on a de facto basis whilst the lawsuit continued, whilst NASCAR's countersuit against 23XI has already been dismissed.
Rivals frustrated with 23XI
Barring a miraculous late agreement being struck, the case is now set to go to trial next week, although it appears that 23XI and FRM do not have the backing of their fellow teams.
That is according to The Athletic's Jordan Bianchi, at least, who reveals that rival teams and their owners are not all on 23XI's side.
"I've talked to a lot of people on the team side and they have made it very clear to me over the past few months that they are frustrated with this and that this is still ongoing," Bianchi said on SiriusXM NASCAR Radio.
"There is frustration a lot with 23XI, 'Why are we continuing to have this fight?' and it's hurting business."
Bianchi continued: "I've had many team owners and presidents tell me: 'Hey, this is hurting us, and this is hurting our sport as we try to go forward.
"Let's just push this to the side and let's end this and move forward."
When does the 23XI vs NASCAR lawsuit begin?
23XI Racing and Front Row Motorsports' lawsuit against NASCAR is scheduled to start being heard in court next week, on December 1.
The length of the trial is yet to be determined and will depend on how long the jury takes to come to their decision. Some have estimated it will go on for 10 days, give or take a day or two.
The trial is set to take place a the US Courthouse in Charlotte, NC.
